Patent costs are generally only a small component of the total cost incurred in turning an invention into a commercially useful technology or product, and of marketing and selling it in the domestic or export markets. A patent application is subject to the payment of a basic fee and additional fees that include a search fee, an examination fee, and issue fee. The costs of patents may be divided into four types of costs. Firstly, the costs relating to the application fees and other prosecution fees paid to the national or regional patent offices. Secondly, the costs relating to patent agents who assist in drafting the patent application. Thirdly, costs of translation. Fourthly, the cost of maintaining applications and patents through payments to the patent office. Such fees are usually paid at regular intervals that are every year or once every five years in order to maintain the application or the patent. Protecting patents for the entire term of protection generally, 20 years in various countries may prove an expensive undertaking, also taking into account that annual maintenance fees are usually increasing the longer the protection is maintained. In calculating fees, a claim is singularly dependent if it incorporates by reference a single preceding claim that may be an independent or dependent claim. A multiple dependent claim or any claim depending there from shall be considered as separate dependent claims in accordance with the number of claims to which reference is made. In addition, if the application contains multiple dependent claims, an additional fee is required for each multiple dependent claim. If small entity status is desired and appropriate, applicants should pay the small entity filing fee. The cost of a patent application and its prosecution costs depend on a number of factors: • Field of technology • Nature of the invention • Length of the patent application • Number of Claims • Nature and number of objections raised by the patent examiner • Number of countries to be covered • Route used for filing abroad • Translations costs of foreign filings • Number and nature of objections raised by the patent examiner and whether there are any opposition proceedings or appeals.
